Welcome to Ahavah Care at Home. These Terms of Service ("Terms") govern your use of our services and constitute a legal agreement between you ("Client," "you," or "your") and Ahavah Care at Home LLC ("Company," "we," "us," or "our"). By engaging our services, you agree to be bound by these Terms.
Important: Please read these Terms carefully before using our services. If you do not agree with any part of these Terms, you should not use our services.
1. Acceptance of Terms
By requesting, receiving, or paying for services from Ahavah Care at Home, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, as well as our Privacy Policy and any other applicable policies or agreements.
These Terms may be updated from time to time. Continued use of our services after changes are posted constitutes acceptance of the modified Terms.
2. Services Provided
2.1 Scope of Services
Ahavah Care at Home provides in-home healthcare services, including but not limited to:
- Home health aide services
- Skilled nursing care
- Physical therapy
- Occupational therapy
- Speech therapy
- Medical social work
- Pediatric care
- Post-surgical and wound care
2.2 Service Customization
Services are provided based on an individualized care plan developed in consultation with you, your physician, and our clinical team. The care plan may be modified as your needs change.
2.3 Service Limitations
We do not provide emergency medical services. In case of a medical emergency, call 911 immediately.
3. Client Responsibilities
3.1 Accurate Information
You agree to provide accurate, complete, and current information about your health conditions, medications, insurance coverage, and emergency contacts.
3.2 Safe Environment
You agree to:
- Maintain a safe, clean environment for caregivers to perform services
- Inform us of any hazards or unsafe conditions in the home
- Ensure adequate lighting, heating/cooling, and working facilities
- Provide necessary medical equipment and supplies as directed
3.3 Cooperation with Caregivers
You agree to treat all caregivers and staff with respect and dignity. Abusive, threatening, or inappropriate behavior toward our staff may result in immediate termination of services.
3.4 Compliance with Care Plan
You agree to follow the prescribed care plan and inform us promptly of any changes in your condition or needs.
4. Payment Terms
4.1 Fees and Rates
Service rates are provided in writing before services begin. Rates may vary based on:
- Type of service required
- Level of caregiver skill needed
- Frequency and duration of visits
- Time of day (weekend/holiday rates may apply)
4.2 Billing
Services are billed based on actual time provided. Billing cycles are typically weekly or bi-weekly unless otherwise agreed in writing.
4.3 Payment Methods
We accept payment via:
- Private pay (check, credit card, ACH)
- Insurance (Medicare, Medicaid, private insurance)
- Long-term care insurance
- Veterans benefits
4.4 Insurance Verification
While we will verify insurance coverage and file claims on your behalf, you are ultimately responsible for payment of all services rendered. You agree to pay any amounts not covered by insurance.
4.5 Late Payments
Payment is due within 30 days of invoice date. Late payments may be subject to interest charges of 1.5% per month (18% annually) or the maximum rate permitted by law, whichever is less.
4.6 Minimum Service Requirements
Certain services may have minimum hour requirements. Cancellations with less than 24 hours notice may be subject to a cancellation fee.
5. Scheduling and Cancellation
5.1 Scheduling
We will make reasonable efforts to accommodate your preferred schedule. However, schedules are subject to caregiver availability and may need to be adjusted.
5.2 Cancellation Policy
If you need to cancel or reschedule a visit, please provide at least 24 hours advance notice. Cancellations with less than 24 hours notice may incur a cancellation fee equivalent to 50% of the scheduled visit cost.
5.3 Our Right to Reschedule
In rare circumstances (caregiver illness, emergency), we may need to reschedule or provide an alternate caregiver. We will notify you as soon as possible.
6. Caregiver Assignment and Continuity
6.1 Caregiver Matching
We carefully match caregivers to clients based on skills, personality, and schedule. While we strive for consistency, we cannot guarantee that the same caregiver will always be available.
6.2 Caregiver Substitution
We reserve the right to substitute caregivers as necessary due to illness, vacation, or other circumstances. Substitute caregivers will be equally qualified.
6.3 Request for Different Caregiver
If you are not satisfied with your assigned caregiver, please contact us immediately. We will work to assign a more suitable caregiver.
7. Termination of Services
7.1 Your Right to Terminate
You may terminate services at any time with or without cause by providing written notice. You are responsible for payment of all services provided through the termination date.
7.2 Our Right to Terminate
We reserve the right to terminate services immediately if:
- Your account becomes more than 60 days past due
- You or anyone in the household engages in abusive, threatening, or inappropriate behavior toward staff
- Conditions in the home become unsafe for caregivers
- You fail to follow the care plan or physician orders in a way that compromises care
- Your needs exceed our capabilities or scope of services
7.3 Transition Assistance
Upon termination, we will provide reasonable assistance in transitioning to another care provider if requested.
8. Confidentiality and HIPAA
We are committed to protecting your privacy and complying with the Health Insurance Portability and Accountability Act (HIPAA) and all applicable privacy laws. Please refer to our Privacy Policy for detailed information about how we collect, use, and protect your personal health information.
9. Liability and Insurance
9.1 Professional Liability Insurance
Ahavah Care at Home maintains professional liability insurance and workers' compensation insurance for all employees.
9.2 Limitation of Liability
To the maximum extent permitted by law, our liability for any claims arising from services provided is limited to the amount paid for services during the three months prior to the incident giving rise to the claim.
9.3 Disclaimer of Warranties
While we strive to provide the highest quality care, services are provided "as is" without warranties of any kind, express or implied, except as required by law.
9.4 Indemnification
You agree to indemnify and hold harmless Ahavah Care at Home and its employees from any claims, damages, or expenses arising from:
- Your failure to provide accurate health information
- Unsafe conditions in your home
- Your failure to follow prescribed medical treatment
- Actions of third parties in your home
10. Background Checks and Caregiver Qualifications
All caregivers undergo:
- Comprehensive background checks including criminal history
- Verification of licenses, certifications, and credentials
- Reference checks from previous employers
- Drug screening
- Ongoing training and competency assessments
11. Emergency Situations
11.1 Medical Emergencies
In the event of a medical emergency, our caregivers are authorized to:
- Call 911 or emergency services
- Provide first aid within their scope of practice
- Contact your designated emergency contacts
- Accompany you to the hospital if appropriate
11.2 Natural Disasters
During natural disasters or severe weather, we will make every reasonable effort to maintain services. However, caregiver safety is paramount, and services may be temporarily suspended if conditions are deemed unsafe.
12. Complaints and Grievances
We take all complaints seriously. If you have concerns about the quality of care or conduct of our staff:
- Contact your Care Coordinator immediately
- If unresolved, escalate to our Director of Nursing or Operations Manager
- File a formal written complaint if necessary
We will investigate all complaints promptly and thoroughly and take appropriate corrective action.
13. Regulatory Compliance
Ahavah Care at Home is licensed and regulated by applicable state and federal agencies. We comply with all applicable healthcare laws and regulations, including but not limited to:
- State home care licensing requirements
- Medicare and Medicaid conditions of participation
- HIPAA privacy and security rules
- OSHA workplace safety standards
14. Intellectual Property
All content on our website, including text, graphics, logos, and images, is the property of Ahavah Care at Home and is protected by copyright and trademark laws. You may not reproduce, distribute, or use any content without our written permission.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms are governed by the laws of the state in which services are provided, without regard to conflict of law principles.
15.2 Dispute Resolution
Any disputes arising from these Terms or our services will first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes may be resolved through mediation or arbitration as mutually agreed, or through the appropriate courts.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Ahavah Care at Home regarding our services and supersede all prior agreements and understandings.
18. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
19. Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.
